Farmway Reward Card Scheme

As part of our commitment to bringing extra value to our Country Store customers, I am pleased to announce that Farmway Country Stores is launching a ‘Spend&Save’ Reward Card to bring additional value to your Farmway Country Store purchases.

As the credit crunch continues to deepen our Reward Card program will enable you to save money every time you spend in one of our Country Stores. Our points-based program will earn you 1 point for every £1 spent* on Pet, Equine, Clothing, Household and other Rural products as sold in our Country Stores (*certain exclusions apply. Please see Reward Card Terms and Conditions for full details).  Triple points are available on all purchases of Farmway own-brand dog food, tinned cat food, horse feed and rat bait.

Exclusively, Farmway members will also receive enhanced benefits and points on their ‘Gold Card’ purchases of additional product categories such as Fencing and Agricultural Sundries.

Terms and Conditions of Membership


1.    Definitions

1.1    In these Terms and Conditions:

“Account” means the Farmway reward card account in the name of the Account Holder.
 
“Account Holder” means the person whose name is on the Card.

“Card” means the Farmway reward card issued to you by us.

 “Farmway Reward Card Scheme” means the reward card scheme operated by Farmway in accordance with these Terms and Conditions.

“Parties” means Farmway Limited and the Account Holder.

“Qualifying Item” means products or items purchased in-store at the full marked retail price specifically excluding:

•    products or items purchased at a discount, on sale or at an individually negotiated price; and
•    animal vaccines;
•    bulk purchases of agricultural items such as animal feed and seed.

“Redemption Items” means items from any in-store purchase.

“us”/“we” means Farmway Limited.

 “you”/”your” means the Account Holder.

1.2     Words in the singular shall include the plural and vice versa and a reference to one gender shall include a reference to the other genders.

2.    Data protection

  This clause describes the information we hold on Account Holders and how we use it. It also tells you how to let us know if you would rather not be on our mailing list and how to ask for a copy of the information we hold on you.

2.1.    Under the Farmway Reward Card Scheme, we will:

2.1.1.    create and maintain a database of Card information, including details on how you use your Card and what you buy;

2.1.2.    supply this Card information to:

1.1.2.1.    third parties that we engage to produce and issue Cards to Account Holders;

1.1.2.2.    third parties that we engage to process and analyse the Card information in order to help us identify marketing or promotional opportunities that may be of interest to you and other Account Holders ;

1.1.2.3.    third parties that will process the information on our behalf or who we may engage from time to time for the purposes of managing or administering the Farmway Reward Card Scheme (or any part of it) on our behalf;

these third parties will be obliged to act only on our instructions and to keep your information secure.

2.2.    Card information that we may hold on our Account Holders may include:

2.3.1.    contact details (including your residential address and e-mail address), other application details and transactional details;

2.3.2.    any other personal data supplied by you, such as information about family members, outdoor pursuits, any animals owned by you and the purpose of owning them;

2.3.3.    data we receive from third parties such as suppliers; and

2.3.4.    information you provide to us in relation to promotional campaigns.

2.3.    Data will be held, used and updated in order to:

2.4.1.    manage the Farmway Reward Card Scheme and provide the service outlined in the Farmway Reward Card Scheme;

2.4.2.    improve existing services and develop new services;

2.4.3.    provide our Account Holders with information about products and services, including information about third party products and services, which we think may be of interest to them;

2.4.4.    enhance customer service;

2.4.5.    send mailings to Account Holders, by post, email, text or fax;

2.4.6.    carry out marketing and market research; and

2.4.7.    to measure the effectiveness of our promotional campaigns and to identify promotions that may be of interest to you in the future.

2.4.    If you do not want us to use your card information to contact you with information about goods and services as outlined above, you may either tick the opt-out box on the Farmway Reward Card Scheme application form or write to “Reward Card Administrator” at Farmway Ltd, Cock Lane, Piercebridge, County Durham, DL2 3TJ. Please note that refusal of consent may mean that certain services and benefits may no longer be available to the Account Holder.

2.5.    You can ask for a copy of the information we hold on you by writing to “Reward Card Administrator”, Farmway Ltd, Cock Lane, Piercebridge, County Durham, DL2 3TJ and enclosing an administration fee of £10.

3.    Membership

3.1    Membership is only open to individuals who are resident in the UK and aged over 18.

3.2     Notwithstanding condition 3.1 we reserve the right to refuse an application for membership at our absolute discretion.

3.3     The Card may be used by you and any other person that you authorise to use the card on your behalf  .  You shall be responsible for the actions of any person that you authorise to use the Card on your behalf.  Unless you have notified us that your card has been lost or stolen in accordance with Clause 7, we shall be entitled to assume that any person using your Card has been authorised to do so on your behalf  and we shall not be under any obligation to make any investigations in relation to the identity of any person using your Card or to verify that they are authorised by you to use the Card.

3.4     By using the Card you accept these Terms and Conditions and agree to be bound by them as amended from time to time by us.

3.5     The Card is issued by and remains the property of Farmway Limited.

4.    Collecting points

4.1     Points are only available for collection on Qualifying Items.

4.2     To collect points for a transaction in-store, your Card must be presented at the checkout prior to the transaction.
 
4.3     You must spend at least £1 in a single transaction for the transaction to qualify for points.  1 point will be awarded for every £1 that is spent. 

4.4     We may award additional points on promotional items or during a specific promotion period but we reserve the right to set a limit on the number of points which may be awarded to you in respect of promotional items on which additional points are awarded.

4.5     We reserve the right to cancel points awarded at any time if the products to which the award relates are returned for any reason and:

4.5.1     A refund of the purchase price is given; or

4.5.2    If the returned products are exchanged for other products, unless the exchange is for products of an equivalent points value. 

4.6     Where the returned products are exchanged for products of a lower points value we are entitled to cancel the balance of points between those originally awarded and those awarded in respect of the replacement products.

4.7     We may issue a quarterly statement to you detailing the amount of points collected at the date of issue of the statement unless the Card has not been used within the previous 12 months in which case we will not issue a statement to you until the Card is used again. 

4.8     We will correct an Account if it is shown to our reasonable satisfaction to be incorrect, but our decision is final.

4.9     Breach of any of the terms and conditions contained herein by you or any person using your Card may result in the points collected on your Card being suspended and or cancelled.

5.    Redeeming points

5.1     You may claim Redemption Items free of charge up to the value of the points on your Account from time to time.  The current value of points is £0.01 for every 1 point.  Your points balance will be reduced by the value of the free items claimed.

5.2     Redemption Items cannot be claimed until points of sufficient value have been credited to you Account.

5.3     Points have no expiry date but shall be cancelled if the Account is closed for any reason.

5.4     Points cannot be transferred, sold or in any way traded.

6.    Termination of  membership

6.1     You may terminate your membership at any time by notifying us in writing and enclosing your Card.

6.2     We may terminate your membership and confiscate your Card at any time at our absolute discretion.

6.3     Membership will automatically terminate on the death of the Account Holder.

6.4     We reserve the right to terminate your membership and close your Account if your Card has not been used in a 12 month period.

7.    Loss/theft of Card

You are responsible for ensuring that your card is kept secure and is not used by any unauthorised persons and (except where we are negligent or at fault) we accept no liability for any loss, theft or unauthorised use of your Card. You must immediately notify us in writing in accordance with clause 9 below of the loss, theft or unauthorised use of your Card.

8.    Our liability

8.1     We accept no responsibility or liability howsoever arising in respect of loss, injury, or damage in connection with membership of the Farmway Reward Card Scheme. 

8.2     Nothing in these Terms and Conditions purports to exclude liability for death or personal injury as a result of our negligence or for fraud or fraudulent misrepresentation.

9.    Notices

9.1     All notices or correspondence will be sent to your home address as notified to us and will be deemed to have been received by you if posted to that address.

10.    Governing law

The Farmway Reward Card Scheme and these Terms and Conditions are governed by English law and shall be subject to the exclusive jurisdiction of the English Courts.

11.    Variation

11.1     We reserve the right to withdraw, cancel, vary or alter the Farmway Reward Card Scheme at any time.

11.2     Products and services provided may be withdrawn or altered without prior notice.

11.3     We reserve the right to vary these Terms and Conditions at any time and shall give as much notice to you as reasonably practicable.  Earning or redeeming points on a Card will constitute acceptance of the revised terms and conditions.

12.    Rights of Third Parties

The Contracts (Rights of Third Parties) Act 1999 shall apply to these Terms and Conditions and a person who is not a Party to these Terms and Conditions shall not have any rights under or in connection with them.

13.    Severance

If any provision of these Terms and Conditions is found by any court or other authority of competent jurisdiction to be invalid, unenforceable or illegal, the other provisions shall remain in full force and effect.
